Do Kwon Faces Likely 12-Year Sentence After Guilty Plea

Terraform Labs co-founder Do Kwon is set to face roughly 12 years in a U.S. federal prison after pleading guilty to multiple fraud charges. The sentence, which comes with more than $19 million in penalties, is expected to be followed by deportation.

Judge Paul Engelmayer, who is overseeing the case, confirmed that Kwon has accepted full responsibility for Terraform’s criminal activities. His cooperation with prosecutors appears to have earned him a lighter punishment than some in the industry have received — notably less than the 25 years handed to FTX founder Sam Bankman-Fried.

Plea Deal Avoids Lengthy Trial
Kwon formally signaled his intent to plead guilty to nine federal charges, including conspiracy to commit fraud and wire fraud. These offenses, tied to the collapse of the Terra blockchain ecosystem, carried a maximum potential sentence of 25 years to life.

The court’s likely 12-year sentence stems from two primary counts:

• Count 1: A scheme involving the Terra blockchain, payment platform Chai, the Mirror Protocol, Genesis stablecoins, and the Luna Foundation Guard (LFG).
• Count 4: Wire fraud through interstate and foreign communications to execute the scheme.

Under the agreement, Kwon has waived his right to appeal and will pay $19 million in fines.

Possible Deportation After Prison
Because Kwon is not a U.S. citizen, he will likely be deported after completing his sentence. While the court could approve an earlier deportation, Judge Engelmayer signaled a preference for Kwon to serve his full term first.

The case remains in flux, as sentencing decisions can change before they are finalized. But for now, the former crypto mogul appears set for a prison term that could define the next decade of his life.
